Workers’ Compensation Insurance in Maryland

Most Maryland employers must secure compensation for covered employees through an authorized insurer, a governmental or private self-insurance group, or individual self-insurance. A county board of education or private noncollegiate institution may use the defined Education Article route.   • Group and Individual Self-Insurance Have Separate Rules

    Section 9-402(a)(1)–(4) lists the ordinary employer routes: authorized insurance, qualifying governmental or private group self-insurance, or individual self-insurance. Subsection (a)(5) separately permits a county board of education or private noncollegiate institution to secure compensation under Education Article §8-402(c) or §7-114(d). Ask which statutory route applies to your entity and obtain the approval or arrangement required for that route. 1

  • The Commission Can Order Coverage After a Hearing

    After a hearing finding that an employer failed to secure compensation for covered employees, §9-407(b) requires an order to secure and maintain insurance through an authorized insurer and submit proof of coverage to the Commission. Keep the order, policy effective date, and proof filing together. 2

  • Penalty Exposure Can Reach $25,000

    After the first hearing finding, the Commission must order a penalty up to $25,000 payable to the Uninsured Employers’ Fund. A second penalty is not automatic: if the employer has not complied within 30 days after the insurance order, the Commission sets another hearing, and only after finding noncompliance at that hearing may it order an additional penalty up to $25,000. Track the order date and proof deadline. 2

  • An Uninsured Employer Loses the Usual Exclusive Remedy

    A covered employee injured while an employer has failed to secure compensation may claim under the Act or bring an action for damages. Treat a cancellation notice as a business interruption and liability issue, and verify replacement coverage is effective before the prior policy ends. 3
