# Workers’ Compensation Insurance in Maryland

Most Maryland employers must secure compensation for covered employees through an authorized insurer, a governmental or private self-insurance group, or individual self-insurance. A county board of education or private noncollegiate institution may use the defined Education Article route. After a hearing finding noncompliance, the Commission must order insurance through an authorized insurer, proof to the Commission, and a penalty up to $25,000; an additional penalty is discretionary only after 30-day noncompliance and a later hearing.[^1][^2]

## What Is Workers’ Compensation?

Workers’ compensation can pay medical care and part of an employee’s lost wages after a work-related injury or illness. If you have staff, check who is covered in each state; owners, contractors and some workers may be treated differently. [Read the national Workers’ compensation guide](/coverage/workers-compensation).

## Maryland Requirements

| Requirement | Details |
| --- | --- |
| Permitted coverage routes | Ordinary employer routes: authorized insurer, qualifying governmental or private self-insurance group, or individual self-insurance; a county board of education or private noncollegiate institution may use the Education Article route[^1] |

## What to Watch for in Maryland

### Group and Individual Self-Insurance Have Separate Rules

Section 9-402(a)(1)–(4) lists the ordinary employer routes: authorized insurance, qualifying governmental or private group self-insurance, or individual self-insurance. Subsection (a)(5) separately permits a county board of education or private noncollegiate institution to secure compensation under Education Article §8-402(c) or §7-114(d). Ask which statutory route applies to your entity and obtain the approval or arrangement required for that route.[^1]

### The Commission Can Order Coverage After a Hearing

After a hearing finding that an employer failed to secure compensation for covered employees, §9-407(b) requires an order to secure and maintain insurance through an authorized insurer and submit proof of coverage to the Commission. Keep the order, policy effective date, and proof filing together.[^2]

### Penalty Exposure Can Reach $25,000

After the first hearing finding, the Commission must order a penalty up to $25,000 payable to the Uninsured Employers’ Fund. A second penalty is not automatic: if the employer has not complied within 30 days after the insurance order, the Commission sets another hearing, and only after finding noncompliance at that hearing may it order an additional penalty up to $25,000. Track the order date and proof deadline.[^2]

### An Uninsured Employer Loses the Usual Exclusive Remedy

A covered employee injured while an employer has failed to secure compensation may claim under the Act or bring an action for damages. Treat a cancellation notice as a business interruption and liability issue, and verify replacement coverage is effective before the prior policy ends.[^3]

## Who Regulates Insurance in Maryland

**Maryland Insurance Administration.** The Maryland Insurance Administration licenses producers and insurers, reviews rates and forms, and investigates complaints about insurance companies and producers. You can use its state lookup or complaint service to check a license or raise an insurance issue.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premiums less returned premiums when Maryland is the insured's home state; excludes risks of Maryland and its political subdivisions When Maryland is the insured's home state, the tax is 3% of gross premiums less returned premiums, except insurance of risks of the State or a political subdivision. For policies effective on or after July 21, 2011, Maryland taxes the entire premium and the broker must charge the tax in addition to premium. Maryland's property and casualty guaranty corporation excludes surplus-lines policies.[^7][^8]

## Providers With Documented State Licenses

These providers publish a national listing for Workers’ compensation; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Maryland; [check the regulator’s license lookup](https://www.apps.insurance.maryland.gov/CompanyProducerInfo/) and confirm state availability for your business when requesting a quote.

- [Corgi](/insurance-providers/corgi) — **Entity:** Corgi Insurance Services, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability.[^11]
- [ERGO NEXT Insurance](/insurance-providers/next-insurance) — **Entity:** Next First Insurance Agency, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** ERGO NEXT’s current license table lists Next First Insurance Agency, Inc. in 50 jurisdictions, including Washington, DC; New York is excluded because its table rows name Next Insurance Services and AP Intego, not Next First. The table is company-reported; it does not establish product availability or provide state-regulator verification for each entry.[^13]
- [Hiscox](/insurance-providers/hiscox) — **Entity:** Hiscox Insurance Company Inc.; **role:** Insurer; **checked:** 2026-09-28. **Scope:** Hiscox’s U.S. company information states that Hiscox Insurance Company Inc. is licensed in all 50 states and the District of Columbia. This is company-reported insurer authority for this entity and does not establish which company issues every Hiscox-branded product.[^12]
- [TechInsurance](/insurance-providers/techinsurance) — **Entity:** Specialty Program Group LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map.[^14]
- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^15]

1. Which of §9-402(a)(1)–(5) applies to our entity, and what approval or education-law arrangement should we document?
2. What is the deadline in any Commission order to file proof of coverage?
3. Does the renewal replace coverage before our existing Maryland policy expires?

## Workers’ Compensation in Maryland: FAQ

### What are the ways to secure workers’ comp in Maryland?

Ordinary employers may use an authorized insurer, a qualifying governmental or private self-insurance group, or individual self-insurance. A county board of education or private noncollegiate institution may use the separate route in §9-402(a)(5) under Education Article §8-402(c) or §7-114(d).[^1]

### What can happen if a Maryland employer does not secure workers’ comp?

After a hearing finding noncompliance, the Commission must order insurance through an authorized insurer, proof to the Commission, and a penalty up to $25,000. It may order an additional penalty up to $25,000 only after the employer fails to comply within 30 days and a later hearing finds that failure.[^2]
