    Arizona treats a contractor and its employees as the original employer’s employees when the hirer retains supervision or control and the work is an integral, routine part of its business. Have the broker review who directs the work and whether it is part of your ordinary operations before excluding contractor payroll. 1

  • A Sole Proprietor’s Waiver Must Be Signed with the Carrier

    A sole proprietor performing services for an employer may waive personal coverage only through a signed and dated waiver with that employer’s insurance carrier. The statute says the proprietor must maintain coverage for any employees working for them, so do not treat the waiver as an exemption for the proprietor’s crew. 2

  • Insurers Must Document a Contractor Premium Finding

    Before assessing premium for a contractor alleged to be an employee under Arizona’s control test, the carrier must prepare written audit or investigation findings and provide them to the employer in advance.
