Last-mile delivery insurance in North Dakota
Chapter 26.1-40.2 requires liability insurance of at least $50,000 for one person, $100,000 for all persons injured, and $25,000 property damage during both the delivery-available period and the delivery-service period, plus uninsured, underinsured, and personal-injury-protection coverages. It does not set a higher limit once the delivery starts. Accepting a Delivery Does Not Raise the Limit
Chapter 26.1-40.2 uses the same $50,000/$100,000/$25,000 liability floor in the delivery-available period and the delivery-service period. A quote that moves to $1 million when a grocery order is accepted is using the passenger chapter's passengers-on-board number, not the delivery chapter. 2
Passenger Coverage Has Three Stages
In chapter 26.1-40.1, both the application-on stage and the engaged stage, after a ride is accepted but before passengers are aboard, stay at $50,000/$100,000/$25,000. The $1 million limit is the passengers-on-board stage. Do not start the $1 million at the moment of acceptance. 1
Personal Auto Typically Skips Food Delivery
Insurance Department Bulletin 2020-4 says personal auto typically does not cover commercial use such as food delivery. The auto page also distinguishes carpooling, which most personal policies cover, from transporting people for hire. A delivery driver needs the chapter 26.1-40.2 policy, not a personal policy that stops at commercial use. 4,3
