Last-mile delivery insurance in Idaho
Idaho Code § 41-2519, effective July 1, 2015, requires primary automobile liability of $50,000 per person, $100,000 per incident, and $25,000 property damage while a driver is logged on and not engaged in a prearranged ride. On a prearranged ride the primary limit is $1 million for death, bodily injury, and property damage. Section 41-2518 defines the service as transportation of passengers and riders. Section 41-2519 has carried the logged-on and on-ride split since July 1, 2015. A quote built on a later model-bill draft is not what this section states. Match the period to the statute: available on the network versus engaged in a prearranged ride. 1
Riders Are Not a Parcel Route
Section 41-2518 speaks of passengers and riders. A delivery of food or packages is outside that definition, so the $1 million ride limit is not a cargo or goods-delivery minimum. Ask what contract, if any, requires cargo coverage, because this chapter does not. 2
Primary Coverage Has to Recognize the Use
The insurance required by § 41-2519 is primary automobile liability that recognizes the driver is available for, or engaged in, the prearranged ride. A personal policy that is silent, or that excludes the use, does not satisfy the section by itself. The company, the driver, or both have to supply the primary limit. 1
