What to Watch for in Hawaii

  • Defense Costs Sit Outside the Limit

    Both the logged-on and on-ride duties in § 431:10C-703 say costs of defense are outside the liability limits. A quote that burns defense inside a $50,000 or $1 million limit does not match that wording. Ask whether the defense obligation is unlimited or capped somewhere else in the form. 1

  • The Statute Describes Passengers

    Section 431:10C-701 defines a prearranged ride as transportation to a passenger and a transportation network company as connecting passengers to drivers. The insurance section does not extend those limits to delivery of food, parcels, or property. Do not use the $1 million ride limit as a grocery-delivery filing. 2

  • Most Surveyed Insurers Exclude the Activity

    The Insurance Division's Act 236 study said that, of the insurers surveyed, all but two exclude coverage for TNC activity. A personal auto policy can drop out at log-on even though the statute still requires primary coverage. Confirm whether your policy is one of the exclusions, and who provides the primary limit if it is. 3
