Last-mile delivery insurance in Missouri

Section 379.1702, beginning April 1, 2017, requires primary automobile liability of $50,000 per person, $100,000 per incident, and $25,000 property damage while a driver is logged on and not engaged in a prearranged ride. On a prearranged ride the primary limit is $1 million for death, bodily injury, and property damage. Section 379.1700 defines the service as transporting riders. The opened sections do not extend those limits to delivery of goods. 1,2

What Is Last-Mile Delivery?

Last-mile delivery insurance is not one standard policy: vehicle liability, vehicle damage and cargo protection can be separate. If your staff deliver orders in company, rented or personal vehicles, check each vehicle, cargo and worker-injury exposure in the quote. Read the national Last-mile delivery guide.

What to Watch for in Missouri

  • The Duty Begins April 1, 2017

Section 379.1702 dates the insurance requirement to April 1, 2017. A form that still describes a pre-2017 voluntary arrangement is not the statutory split. The logged-on period and the ride are both mandatory from that date for drivers the section covers. 1

  • Riders Are the Covered Trip

Section 379.1700 defines the prearranged ride around transporting riders. A courier route that never carries a rider is outside that definition. The $1 million limit is not a parcel or restaurant-delivery minimum. 2

  • Primary Means It Does Not Wait

The statute requires primary automobile liability in each period. An excess policy that pays only after a personal auto insurer denies the claim does not meet that wording if the personal policy excludes the ride. Ask which insurer is primary at log-on. 1

Who Regulates Insurance in Missouri

Missouri Department of Commerce and Insurance

Missouri DCI licenses insurance producers and insurers, reviews property and casualty rates and forms, and investigates complaints against insurance companies and producers. 3,4,5,6

Surplus-lines tax and stamping office

Reported tax rate: 5% of premium; Missouri taxes the entire gross premium when Missouri is the home state When Missouri is the insured’s home state, the state applies its 5% surplus-lines tax to the entire gross premium of a multistate policy; the regulator’s FAQ says the tax includes applicable fees. Eligible nonadmitted insurers do not participate in the Missouri Guaranty Fund, and Missouri generally requires the full amount or kind of coverage to be unavailable from admitted insurers before placement; an exempt commercial purchaser search exception has separate disclosure and written-request conditions. 7,8,9,10

Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. Check the regulator’s license lookup and confirm availability with a provider when requesting a quote.
