Last-mile delivery insurance in Texas
The Texas Department of Insurance says most personal auto policies do not cover accidents while you are driving for a ride-hailing service or delivering food or other items for a fee. Enrolled House Bill 4215, effective September 1, 2025, adds delivery network companies to Occupations Code Chapter 2402 and defines them as arranging delivery of food, beverages, or consumer goods, but it sets no automobile liability limit. Chapter 1954 of the Insurance Code, from House Bill 1733 effective January 1, 2016, still applies to transportation network companies: $50,000/$100,000/$25,000 before a prearranged ride and $1 million aggregate on the ride. 1,2

Food Delivery for a Fee Sits Outside Most Personal Policies
TDI's auto guide says most policies do not cover an accident while you are delivering food or other items for a fee, in the same sentence as ride-hailing. A personal policy is the wrong place to look for a grocery or restaurant route. Ask for the commercial or delivery form that does not use that exclusion. 1
The Delivery-Network Statute Sets No Auto Limit
House Bill 4215 regulates delivery network companies and does not contain an insurance limit. Occupations Code § 2402.101 says the requirements of Insurance Code Chapter 1954 apply to transportation network companies and drivers, not to the delivery-network addition. Do not borrow the $1 million passenger-ride aggregate and call it the delivery minimum. 2,3
Chapter 1954 Is Still a Rider Chapter
House Bill 1733 requires insurance that allows the driver to transport transportation network company riders for compensation. The logged-on minimum is $50,000/$100,000/$25,000 and the prearranged ride is a $1 million aggregate. Later bills that were opened did not change those limits. They still describe riders. 4,5

Reported tax rate: 4.85% of gross premium plus 0.04% SLTX stamping fee When Texas is the insured’s home state, the state tax is 4.85% of gross premium; absent a compact allocation agreement, a multistate policy can be taxed on its entire premium. Policies effective on or after Jan. 1, 2024 also carry a 0.04% stamping fee; SLTX invoices the broker and says the insured pays it, and the surplus-lines insurer is not covered by the Texas guaranty association. 9,10,11
