P.L. 2017, c. 26 requires $50,000/$100,000/$25,000 while a driver is logged on and not providing a prearranged ride, plus personal injury protection and uninsured/underinsured motorist coverage. On a prearranged ride the primary limit is $1.5 million, with at least $10,000 medical payments for the driver and $1.5 million uninsured/underinsured motorist coverage. The Act Bars Freight Unless Another Law Allows It
Section 3 of the enacted chapter says a transportation network company or driver shall not provide freight service except as authorized by applicable law. A parcel or restaurant delivery is not the prearranged rider trip the $1.5 million limit covers. Do not use the TNC policy as a freight filing unless a separate authorization puts that delivery inside a permitted service. 1
The Ride Is $1.5 Million, Plus Medical Payments
The on-ride duty is not a flat $1 million. It is $1.5 million for death, bodily injury, and property damage, at least $10,000 medical-payments benefits for the driver only, and $1.5 million uninsured/underinsured motorist coverage. A quote missing the driver medical-payments benefit is short of the chapter. 1
Personal Policies Typically Exclude Livery
The Department of Banking and Insurance's 2014 release says personal auto policies typically exclude public or livery use. The logged-on period can be that use. If the personal policy excludes it, the company policy has to carry the $50,000/$100,000/$25,000 primary limit and the PIP and UM/UIM the statute adds. 2

A New Jersey surplus-lines producer generally must make a diligent effort to place the risk with authorized insurers, subject to the exportable-list and other statutory exceptions.
