Last-mile delivery insurance in New York
The Department of Financial Services says Vehicle and Traffic Law Article 44-B, effective June 29, 2017, requires at least $75,000/$150,000/$25,000 while a driver is logged onto a transportation network company's digital network, plus uninsured-motorist and no-fault coverage. On a prearranged trip the requirement is at least $1.25 million for bodily injury and property damage, plus $1.25 million supplemental uninsured/underinsured motorist coverage and no-fault. A trip that originates in New York City is outside Article 44-B. The registration policy may exclude the logged-on period and the trip if it contains that exclusion. 1

What to Watch for in New York
A Pickup in New York City Is Outside the Article
The Department says Article 44-B does not apply to a prearranged trip originating in New York City. A vehicle that picks up a passenger there, even through a digital network, has to meet other state and city rules. Dropping a passenger in the city is still inside the article if the pickup was outside the city. Do not use the 75/150/25 figure for a city-origin trip. 1
Black Cars and For-Hire Vehicles Are Not TNC Vehicles
Article 44-B excludes livery vehicles, taxicabs, for-hire vehicles, limousines, black cars, and buses from the TNC-vehicle definition. Those vehicles stay under their own insurance rules. A goods delivery is not the passenger trip the article defines, and Article 44-B also does not require physical-damage coverage for the driver's own car. 1
The Registration Policy May Exclude the App
The Department says the policy used to register the vehicle may exclude coverage, including no-fault, while the driver is logged on and during the trip, if the policy contains that exclusion. If that coverage lapses, the company's group policy must respond from the first dollar, and it may not include a liability deductible. Insurance Regulation 35-E states a $1,250,000 limit while the driver is engaged in a prearranged trip when the policy provides the Article 44-B liability coverage. 1,2

Surplus-lines tax and stamping office
Reported tax rate: 3.6% of gross premium, less returned premium; ELANY stamping fee is 0.15% through 2026 and 0.17% for policies incepting on/after Jan. 1, 2027 When New York is the insured’s home state, excess-line tax is 3.6% of gross premium less returned premium.
