# Last-mile delivery insurance in North Dakota

Chapter 26.1-40.2 requires liability insurance of at least $50,000 for one person, $100,000 for all persons injured, and $25,000 property damage during both the delivery-available period and the delivery-service period, plus uninsured, underinsured, and personal-injury-protection coverages. It does not set a higher limit once the delivery starts. The passenger-network chapter is different: application-on and engaged stages, before passengers are aboard, are also $50,000/$100,000/$25,000, and the passengers-on-board stage is $1 million. Bulletin 2020-4 says personal auto typically does not cover commercial use such as food delivery.[^2][^4]

## What Is Last-Mile Delivery?

Last-mile delivery insurance is not one standard policy: vehicle liability, vehicle damage and cargo protection can be separate. If your staff deliver orders in company, rented or personal vehicles, check each vehicle, cargo and worker-injury exposure in the quote. [Read the national Last-mile delivery guide](/coverage/last-mile-delivery).

## North Dakota Requirements

| Requirement | Details |
| --- | --- |
| Delivery available and delivery service | $50,000 / $100,000 / $25,000, plus UM, UIM, and PIP[^2] |
| Passenger TNC, passengers on board | $1 million, plus UM, UIM, and PIP[^1] |

## What to Watch for in North Dakota

### Accepting a Delivery Does Not Raise the Limit

Chapter 26.1-40.2 uses the same $50,000/$100,000/$25,000 liability floor in the delivery-available period and the delivery-service period. A quote that moves to $1 million when a grocery order is accepted is using the passenger chapter's passengers-on-board number, not the delivery chapter.[^2]

### Passenger Coverage Has Three Stages

In chapter 26.1-40.1, both the application-on stage and the engaged stage, after a ride is accepted but before passengers are aboard, stay at $50,000/$100,000/$25,000. The $1 million limit is the passengers-on-board stage. Do not start the $1 million at the moment of acceptance.[^1]

### Personal Auto Typically Skips Food Delivery

Insurance Department Bulletin 2020-4 says personal auto typically does not cover commercial use such as food delivery. The auto page also distinguishes carpooling, which most personal policies cover, from transporting people for hire. A delivery driver needs the chapter 26.1-40.2 policy, not a personal policy that stops at commercial use.[^4][^3]

## Who Regulates Insurance in North Dakota

**North Dakota Insurance Department.** The North Dakota Insurance Department regulates insurers and producers, provides licensing and company searches, and investigates insurance complaints to assess compliance with state law and policy terms.[^5][^6][^7]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.75% of gross premium, assessments and policy fees, less return premium, when North Dakota is home state When North Dakota is the insured’s home state, the 1.75% tax applies to the entire gross premium, assessments, membership and subscriber fees, and policy or service fees on multistate policies, less return premium. North Dakota permits independent procurement only under separate statutory conditions; the policyholder should confirm whether a licensed broker placement or independent procurement applies. Nonadmitted insurers generally do not participate in state guaranty funds.[^8][^9][^10]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://www.insurance.nd.gov/producers/print-license) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in North Dakota

1. Is the delivery quote at $50,000/$100,000/$25,000 in both periods, with UM, UIM, and PIP?
2. If the driver also takes passengers, does $1 million wait until passengers are on board, as chapter 26.1-40.1 says?
3. Does the personal policy exclude food delivery the way Bulletin 2020-4 describes?
