    Joint liability may be imposed on defendants who consciously conspire and deliberately pursue a common plan or design to commit a tortious act or omission. A person held jointly liable has a right of contribution from other defendants that acted in concert. If the complaint alleges that kind of plan, the excess layer can be asked for more than a single percentage, and the contribution claim against co-defendants should be noticed to the carrier. 2

    Section 17D-4-2 does not use a smaller property figure. The three amounts are $25,000, $50,000, and $25,000. An application that schedules $10,000 property underlying limits will not meet this proof section. Confirm the auto declarations before the umbrella is issued. 1
