Michigan Umbrella and Excess Liability Guide
For a policy delivered in Michigan on a vehicle registered or principally garaged here, MCL 500.3009 sets residual liability, after July 1, 2020, at not less than $250,000 for bodily injury or death of one person, $500,000 for two or more persons, and $10,000 for property damage. The named insured may choose lower bodily-injury limits, but not lower than $50,000 and $100,000, only by completing the director’s form. MCL 600.6304 makes liability in a covered multi-person injury case several only, so a person is not required to pay more than that person’s percentage of fault, except a defendant that is jointly and severally liable under section 6312. The umbrella has to schedule the limit that was actually selected, not a generic national floor. 1,2

What to Watch for in Michigan
The lower limit exists only if the director’s form was completed
Subsection (5) ties the $50,000/$100,000 option to a completed form that meets subsection (7), provided as required by section 3107e. On renewal, subsection (6) requires the insurer to provide the available options, a price for each option, and the form. Before an umbrella underwriter accepts $50,000 as the scheduled underlying limit, get the form and the declarations. The default in subsection (1) remains $250,000/$500,000 if that choice was not made. 1
A named excluded driver voids liability coverage while that person drives
Subsection (2) allows an exclusion of a named person only with a prescribed warning on the policy face, declaration, or certificate, and on the certificate of insurance: when that person operates the vehicle, all liability coverage is void and no one is insured. Owners remain personally liable. An umbrella that follows the auto policy does not restore liability the auto policy has voided for that driver. Ask who is listed as a named excluded driver. 1
Several liability changes how much of a verdict the excess layer can be asked to pay
Section 6304(4) says liability is several only and not joint, and a person shall not be required to pay damages greater than that person’s percentage of fault. It does not apply to a defendant jointly and severally liable under section 6312. Price the excess layer against the insured’s own percentage unless that exception applies, and still compare the percentage share with the scheduled underlying limit, because the excess form attaches above the schedule rather than above the verdict. 2
