Nevada Umbrella and Excess Liability Guide

NRS 485.185 requires every owner of a motor vehicle registered or required to be registered in Nevada to maintain, while the vehicle is present or registered here, liability insurance of $25,000 for bodily injury or death of one person, $50,000 for two or more persons, and $20,000 for property of others, from an insurer licensed by the Division of Insurance. NRS 42.005 then limits exemplary or punitive damages, except for the defendants listed in subsection 2, to three times compensatory damages if those damages are $100,000 or more, or to $300,000 if compensatory damages are less than $100,000. The underlying auto policy has to stay in force continuously. The punitive cap is a judgment limit, not a reason to drop the excess layer on a products or bad-faith count that subsection 2 removes from the cap. 1,2

What to Watch for in Nevada

  • The punitive multiple depends on whether compensatory damages reach $100,000

    If compensatory damages are $100,000 or more, NRS 42.005 limits punitive damages to three times that amount. If they are less than $100,000, the limit is $300,000. A $90,000 compensatory award and a $100,000 compensatory award do not share a formula. Ask which side of that line the verdict is on before you compare it with the excess limit. 2

  • Products, insurer bad faith, and discrimination claims are outside the cap

    Subsection 2 says the limitations do not apply to an action against a manufacturer, distributor, or seller of a defective product; an insurer who acts in bad faith regarding its obligation to provide coverage; or a person for violating a state or federal law prohibiting discrimination. Those counts can be pleaded above the capped amount. Read the rest of subsection 2 for any additional category before you tell an insured the cap applies. 2

  • A lapse while the vehicle is in Nevada breaks the statutory insurance

    The duty is continuous while the motor vehicle is present or registered in this state, and the insurer must be licensed by the Division of Insurance and approved to do business here. An umbrella that assumes a $25,000/$50,000/$20,000 underlying policy does not satisfy NRS 485.185 during a cancellation gap. Ask for the policy term that covers the date of the crash, not only the application date. 1
