Ohio Umbrella and Excess Liability Guide

Ohio Revised Code 4509.101 prohibits operating a motor vehicle, or permitting its operation, unless proof of financial responsibility is maintained continuously throughout the registration period. Section 4509.01 defines that proof as the ability to respond in damages of $25,000 for bodily injury or death of one person, $50,000 for two or more persons, and $25,000 for property of others. Section 2315.21 then limits the punitive or exemplary judgment the court may enter, in the ordinary case, to two times the compensatory damages awarded against that defendant. A small employer or individual faces the lesser of two times compensatory damages or 10 percent of net worth when the tort was committed, up to $350,000. What to Watch for in Ohio

  • The duty runs through the whole registration period

    Section 4509.101(A)(1) requires the proof continuously, not only on the day the vehicle is registered. A cancellation mid-term is an operation offense for the owner who permits operation, and for a non-owner driver the proof is measured against that driver’s operation. An umbrella does not satisfy 4509.101 by itself if the underlying proof has lapsed. A violation is subject to the license suspensions in division (A)(2). 1

  • Ordinary punitive judgments stop at two times compensatory damages

    Section 2315.21 says the court shall not enter judgment for punitive or exemplary damages in excess of two times the compensatory damages awarded to the plaintiff from that defendant. Attorney fees awarded on a punitive claim are addressed separately in the same division. Compare the excess limit with two times the compensatory award, not with the jury’s raw punitive number, unless an exception applies. 3

  • A small employer uses a tighter punitive ceiling

    If the defendant is a small employer or individual, the court shall not enter a punitive judgment in excess of the lesser of two times compensatory damages or 10 percent of net worth when the tort was committed, up to a maximum of $350,000. The section uses its own definition of a small employer. It does not apply when the injury resulted from the defendant acting purposely or knowingly, as described in section 2901.22, and the defendant has been convicted of or pleaded guilty to a felony that had one of those mental states as an element and that is the basis of the tort action. It also does not apply to tort actions against the state in the court of claims, including certain state-university actions under section 3345.40. Read those exceptions before you rely on either ceiling. 3
