Washington Umbrella and Excess Liability Guide

RCW 46.29.090 says no policy or bond is effective under RCW 46.29.080 unless it provides, exclusive of interest and costs, at least $25,000 for bodily injury or death of one person, $50,000 for two or more persons, and $10,000 for property of others, and unless the insurer or surety is authorized to do business in Washington, with a narrow exception in subsection (2). RCW 4.22.070 makes each defendant’s liability several only, except where persons acted in concert or one was an agent or servant of the other, and except where the claimant was not at fault, in which case defendants against whom judgment is entered are jointly and severally liable for the sum of their proportionate shares. 1,2

What to Watch for in Washington

  • A lower auto limit is not effective under RCW 46.29.080

    The statute does not merely prefer $25,000/$50,000/$10,000. It says no policy or bond is effective under RCW 46.29.080 unless those limits are present and the company is authorized in Washington, except as subsection (2) provides for a vehicle registered elsewhere. An umbrella cannot cure an underlying policy that the financial-responsibility section treats as ineffective. Confirm the insurer’s Washington authority and the three limits. 1

  • The default is several liability for the defendant’s own share

    RCW 4.22.070(1) says the liability of each defendant shall be several only and shall not be joint, except in the cases the subsection lists. A person is responsible for another’s fault where both acted in concert or where a person was acting as an agent or servant of the party. If the claimant or the person who suffered the injury was not at fault, the defendants against whom judgment is entered are jointly and severally liable for the sum of their proportionate shares of the claimant’s total damages. That joint figure is the sum of their shares, not an invitation to add a nonparty’s fault. 2

  • Joint liability brings contribution rights with it

    Subsection (2) says that if a defendant is jointly and severally liable under one of those exceptions, that defendant’s contribution rights against another jointly and severally liable defendant, and the effect of a settlement by either, are governed by the rest of that subsection. An excess carrier that pays more than a several share because the claimant was fault-free should ask about contribution before it closes the file. 2

Reported tax rate: 2% of premium The NAIC's state chart lists a 2% of premium charge for surplus-lines coverage for Washington (the chart's state entries were reviewed in October 2025). Your broker may collect the applicable amount with the premium. Surplus-lines insurers are not licensed in the state and generally are outside state guaranty-association protection; ask your broker to explain the insurer's financial protections and any diligent-search requirement that applies to your placement. 6,7
