North Dakota Umbrella and Excess Liability Guide

North Dakota Century Code chapter 39-16.1 requires proof of financial responsibility for the future from a person convicted of certain motor-vehicle offenses or who has failed to pay a judgment arising out of the ownership, maintenance, or use of a registrable vehicle. It is not a rule that every driver must carry those limits before any crash. Section 39-16.1-11 says an owner’s policy certified as that proof must cover $25,000 for bodily injury or death of one person, $50,000 for two or more persons subject to the one-person limit, and $25,000 for property of others, exclusive of interest and costs, in the United States or Canada, including a permitted user. Section 32-03.2-02 then allocates injury damages: recovery is barred when the claimant’s fault is as great as the combined fault of everyone else who contributed, and otherwise damages are reduced. When more than one party contributed, liability is several only unless they acted in concert. 1,2

    Section 39-16.1-01 applies the chapter’s proof requirement, subject to exemptions, to a person convicted of or who forfeited bail for certain motor-vehicle offenses, or who failed to pay a judgment on a vehicle claim. Section 39-16.1-02, which used to define proof, was repealed in 2013. Do not treat a repealed definition as the current compulsory limit. Ask whether this insured has been ordered to file proof for the future, and whether the underlying policy is the certified policy described in section 39-16.1-11. 1

  • A judgment is treated as satisfied at the same three amounts, for this chapter only

    Section 39-16.1-05 says that, for the purpose of this chapter only, a judgment is deemed satisfied when $25,000 has been credited for bodily injury or death of one person, $50,000 for two or more persons subject to the $25,000 one-person limit, or $25,000 for property. Settlement payments are credited against those amounts. Paying the chapter’s satisfaction figure does not cap the civil judgment itself. An umbrella can still sit above a loss the chapter treats as satisfied for licensing purposes. 1

  • Fault as great as everyone else’s combined fault ends the recovery

    Section 32-03.2-02 bars recovery for death or injury to person or property when the claimant’s fault was as great as the combined fault of all other persons who contributed. Short of that bar, damages are diminished in proportion to the claimant’s fault. If two or more parties contributed, each is liable only for that party’s percentage, unless they acted in concert, aided the act, or adopted it for their benefit, in which case they are jointly liable for their combined percentage. Fault under this section includes malpractice. 2
