The New Mexico Motor Vehicle Division says the minimum auto liability amounts are $25,000 for bodily injury to or death of one person, $50,000 for bodily injury to or death of two or more persons, and $10,000 for property damage in any one accident. After the policy is bought, the insurer is asked to report it to the Insurance Identification Database. If MVD sends a Notice of Noncompliance and the insurer does not report within 30 days of the date on that notice, MVD suspends the registration. Rule 18.18.5.8 NMAC says the evidence of financial responsibility that must be carried in the vehicle is executed by the insurer, the surety, or the state treasurer, and it lists what that evidence has to show, with a fleet exception that drops the vehicle description when the card says any owned vehicle is insured. What to Watch for in New Mexico
A bought policy can still lose the registration if the database is not updated
MVD says that if you have the minimum liability insurance and still receive a Notice of Noncompliance, the insurer must provide the information to the Insurance Identification Database within 30 days of the date on the notice or the registration will be suspended. You can also call the database yourself. An umbrella sitting over a policy that MVD has suspended for a missing report is not proof the underlying registration coverage is in force. 1
The card in the vehicle has six required items, unless it is a fleet card
Rule 18.18.5.8 requires the evidence carried in the vehicle to be executed by the insurer, surety, or the state treasurer. It must show the name and address of the insured or owner, the year and make, the vehicle identification number, the policy, bond, or deposit number, the effective date, and the expiration date if applicable. A liability policy that insures any owned vehicle may omit the year, make, and identification number if the certificate says “fleet—any owned vehicle” on its face. 2
Registration can be refused when the file does not show coverage
MVD says registration may be denied or delayed if its registration file does not show insurance coverage, and that drivers without the minimum liability insurance may have the registration suspended. It also says drivers who provide fraudulent proof of insurance documents may be prosecuted. A letter on company letterhead, a current card, or a copy of the policy are the forms of proof MVD lists for registration. An umbrella certificate is not on that list. 1
