New Jersey Umbrella and Excess Liability Guide

P.L. 2022, c. 87 amended N.J.S.A. 39:6B-1 so that every owner of a motor vehicle registered or principally garaged in New Jersey maintains liability insurance for bodily injury, death, and property damage. For a plan issued or renewed on or after January 1, 2026, the floor is $35,000 for injury to or death of one person in one accident, $70,000 for injury to or death of more than one person, and $25,000 for property damage. The same act left a lower schedule in place for plans issued or renewed on or after January 1, 2023 but before January 1, 2026: $25,000, $50,000, and $25,000. Department of Banking and Insurance Bulletin 25-06 tells admitted and surplus lines insurers that the January 1, 2026 phase applies to new and renewal policies and that property damage stays at $25,000. An umbrella sits above whatever underlying policy is actually in force, which depends on the issue or renewal date. 1,2

What to Watch for in New Jersey

  • The underlying limit depends on the issue or renewal date

    A policy issued or renewed on or after January 1, 2023 and before January 1, 2026 was written to the $25,000 and $50,000 bodily-injury schedule, with $25,000 property damage. The $35,000 and $70,000 bodily-injury schedule attaches when that policy is issued or renewed on or after January 1, 2026. Read the declarations date before you assume the umbrella’s underlying requirement matches the 2026 floor. 1

  • A basic or special automobile policy is a different floor

    Subsection b of the amended 39:6B-1 lets an owner of an automobile registered or primarily garaged in the state satisfy the section with a basic automobile insurance policy under N.J.S.A. 39:6A-3.1. Subsection c allows a special automobile insurance policy under N.J.S.A. 39:6A-3.3. Bulletin 25-06 states that the act does not apply to the basic policy. Do not schedule an umbrella as if every New Jersey auto policy now carries $35,000. 1,2

  • The insurer raises the limit and tells the named insured

    On renewal of a policy whose original limits would no longer meet the section, the insurer shall notify the named insured that the limits have been increased and shall specify which limit increased. The act says the insurer is not required to receive a signed coverage selection form under N.J.A.C. 11:3-15.7 to make that increase. Bulletin 25-06 repeats the notice duty and the same form point, and it tells insurers to have approved rates on file for the new minimums. 1,2

A New Jersey surplus-lines producer generally must make a diligent effort to place the risk with authorized insurers, subject to the exportable-list and other statutory exceptions.
