  • Fifty-one percent of causal negligence makes the share joint

    Section 895.045(1) measures the plaintiff’s negligence separately against each person found causally negligent. Below 51 percent, liability is limited to that percentage of total causal negligence. At 51 percent or more, the person is jointly and severally liable for the damages allowed. Subsection (2) adds joint and several liability for a common scheme or plan, notwithstanding subsection (1), except as section 895.043(5) provides. Use this statute for a negligence injury.
