ORS 12.080 says an action upon a contract or liability, express or implied, shall be commenced within six years, excepting those mentioned in ORS 12.070, 12.110, and 12.135, and except as otherwise provided in ORS 72.7250. The same six years cover an action for taking, detaining, or injuring personal property, except an action mentioned in ORS 12.137. ORS 31.610 then allocates a negligence judgment: each person’s several share is the total damages found by the trier of fact, with no reduction for settlement or contribution, multiplied by that person’s fault percentage. A motion within one year after the judgment is final can reallocate an uncollectible share, including the claimant’s fault percentage. Section 12.080(1) excepts actions mentioned in ORS 12.070, 12.110, and 12.135, and it yields where ORS 72.7250 provides otherwise. The chapter’s own index describes 12.110 as covering certain personal injuries not arising on contract and an action for professional malpractice. A technology claim pleaded as professional negligence can be in that exception. Read 12.110 and 12.135 before you tell a customer the contract period is six years. 1

Subsection (4) gives six years for taking, detaining, or injuring personal property, including specific recovery, except an action mentioned in ORS 12.137. Damage to a customer’s equipment can be this action or a contract action. Both are six years on this section, and the exceptions differ. Identify the subsection before you pick an accrual date. 1
The several share uses the full damages figure, then the fault percentage
ORS 31.610 states the share as total damages found by the trier of fact, without reducing that total for amounts paid in settlement or by contribution, multiplied by the person’s percentage of fault. An uncollectible share can be reallocated on a motion made not later than one year after the judgment becomes final by lapse of the time for appeal or after appellate review. The reallocation includes the claimant’s own fault percentage. This is a negligence allocation. It is not a way to divide a contract fee. 2
