  • A writing and an unwritten promise do not share a period

    Subsection 1(b) is six years for a contract founded upon an instrument in writing, except actions mentioned in the preceding sections of chapter 11. Subsection 2(c) is four years for a contract not founded upon an instrument in writing. An email chain may or may not be an instrument in writing. Ask counsel which subsection fits before you assume six years. The opening clause also says the periods apply except as NRS 40.4639, 125B.050, and 217.007 provide, and unless a specific statute limits the action further. 1

  • A deceptive-trade-practice count accrues on discovery and is four years

    Subsection 2(d) covers an action against a person alleged to have committed a deceptive trade practice in violation of NRS 598.0903 to 598.0999, except as NRS 11.245 provides. The cause of action accrues when the aggrieved party discovers, or by due diligence should have discovered, the facts constituting the practice. A technology marketing claim pleaded under that chapter is not the six-year writing period. It is this discovery rule. 1

  • The punitive formula flips at $100,000 of compensatory damages

    NRS 42.005 limits exemplary or punitive damages to three times compensatory damages if those damages are $100,000 or more, and to $300,000 if they are less than $100,000. Subsection 2 says the limitations do not apply to an action against a manufacturer, distributor, or seller of a defective product, an insurer who acts in bad faith regarding its obligation to provide coverage, or a person for violating a state or federal law prohibiting discrimination. Read the rest of subsection 2 before you treat that list as closed. A pure professional-negligence count is not one of those three categories on its face. 2
