Contract Review Should Lead to Identifiable Policy Requirements

CFC’s application asks about the applicant’s products, services and contracts. Its brochure is a product description, not a determination that a particular indemnity is insured. Lockton describes contract review within its technology practice, alongside cyber, D&O and international program design. Lockton describes claims consulting that includes policy mapping, claim presentations and discussions with insurer representatives. CFC markets cyber monitoring and technical incident response, alongside claim-notification channels. A buyer may value both functions: technical containment does not by itself answer who will advocate over coverage, and advocacy does not establish who restores affected systems. An Adviser’s Mandate Does Not Establish Authority to Bind

Lockton’s terms say it is generally not authorized to bind insurers except in circumstances it seeks to disclose, and do not guarantee placement on acceptable terms. The same engagement should identify compensation. Lockton discloses commissions and negotiated fees, potentially together, with further compensation categories. CFC’s reviewed public documentation leaves buyer-facing charges undisclosed. Neither establishes a standard cost for this negotiation or placement. 42

The U.S. technology application asks a senior staff member to complete it and return it to the company’s insurance broker. It requests revenue, funding, subsidiaries, products, major contracts, security controls, IP procedures and claims history.
