Fidelity and Surety Requirements for Idaho Escrow Agencies

Idaho’s Escrow Agency Act creates a specific financial-responsibility package for licensed escrow agencies—not a general business bond rule. The default fidelity bond is $200,000 aggregate with a deductible no higher than $10,000 and named classes of agency personnel; a statutory certificate-of-deposit alternative and director waiver authority qualify the bond package. Separate E&O and trust-balance-based surety requirements address different exposures. 1

What Is Fidelity Bonds?

Fidelity coverage can reimburse certain losses when employees steal money or property they handle. If employees manage company funds, customer property or benefit-plan assets, identify each owner and compare the required protection for each interest. Read the national Fidelity bonds guide.

Idaho Requirements

RequirementDetails
Fidelity amount and peopleAt application, renewal or reinstatement, a licensed escrow agency must show a $200,000 aggregate fidelity bond with a deductible no greater than $10,000 covering the agency and specified officers, partners, managing members, escrow agents and employees; §30-909 also allows a certificate of deposit in lieu of the bonds and permits the director to waive or modify requirements for good cause. 1
Separate financial-responsibility itemsThe statute separately requires E&O protection of at least $50,000 (or a specified deposit alternative) and a surety bond calculated from average month-end escrow trust-account balances. 1,2

What to Watch for in Idaho

  • Do not mistake the surety bond for employee-dishonesty coverage

Section 30-909 lists fidelity, E&O and surety as distinct items. Its default fidelity bond protects against dishonest loss; the surety bond reimburses people for loss from violations of the Act. The section permits a qualifying certificate of deposit in lieu of the listed bonds and lets the director waive or modify requirements for good cause, so confirm the agency’s approved arrangement before treating every item as an insurance policy. 1

  • Check the required deductible and personnel class

The fidelity bond’s deductible may not exceed $10,000 and the required covered group includes the agency, corporate officers, partners, managing members, escrow agents and employees. Ask the carrier to confirm coverage follows each role and agency entity that handles client escrow funds. 1

  • Keep the surety calculation tied to escrow balances

The separate surety amount is based on the agency’s average month-end escrow trust-account balance for the preceding calendar year and uses statutory brackets. Reconcile that balance with the regulator filing; do not use it as the fidelity limit or treat the $200,000 fidelity amount as a universal Idaho business minimum. 1,2

Reported tax rate: 1.5% of premium when Idaho is the home state for property and casualty coverage Idaho’s surplus-lines tax is 1.5%. For property-and-casualty insurance other than workers’ compensation, if Idaho is the insured’s home state the full premium is taxed regardless of where covered risks are located; other lines follow the statutory allocation rule. Surplus-lines policies do not receive Idaho guaranty-association protection. 5,6,8

Providers With Documented State Licenses

These providers publish a national listing for Fidelity bonds; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm the product is available in Idaho. Check the regulator’s license lookup and confirm state availability for your business when requesting a quote.

  • TechInsuranceSpecialty Program Group LLCInsurance producer · checked 2026-09-28TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map. 14
  • VouchVouch Specialty Insurance Services, LLCInsurance producer · checked 2026-09-28Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability. 15
