What to Watch for in Georgia
Model each association’s money separately
The Georgia rule measures maximum funds the broker collects, maintains, controls, can access or disburses, with a floor based on three months of assessments plus required reserves. Give the broker both the highest balance and the reserve requirement for every managed association; a low average balance does not answer the rule’s maximum-funds test. 1
Check the association’s status on the evidence
The association must be named as an additional named insured, and the bond or policy must cover the broker, partners, officers, licensed affiliates and employees. Ask for the association-specific certificate and verify the people with system access are included; a general certificate for the management company alone may not show those details. 1
Confirm the notice and any pooled alternative
The rule calls for 30 days’ advance written notice of cancellation, substantial modification or nonrenewal, reduced to at least 10 days for nonpayment. A separate bond or policy is the default, while alternate fidelity coverage requires Commission acceptance—do not treat a master policy as automatically satisfying each association’s requirement. 1
