Maine defines an employer to include in-state employers with any number of employees and out-of-state employers whose employees usually work in Maine, subject to a narrow religious/fraternal exception. What to Watch for in Maine
The Human Rights Act has no general employee minimum
Maine’s statutory employer definition covers any number of employees and expressly includes out-of-state employers whose workers usually work in Maine. A limited religious/fraternal exception has a disability-related carveout. 1
Every employee gets an annual written notice
Maine requires individual written notice each year about harassment illegality and definitions, internal and Commission complaint routes, contact information, and anti-retaliation protections. The statute says delivery must ensure notice to every employee. 2
Training has a separate 15-employee threshold
Workplaces with 15 or more employees must train new employees within one year; the statute also specifies training content, additional supervisor training, and three-year record retention. Do not confuse this threshold with the Act’s employer definition. 2
Commission complaints generally have 300 days
Maine §4611 requires a complaint within 300 days after the alleged act. Track this state period while separately checking other possible routes and policy notice obligations. 3

Reported tax rate: 3% of gross direct premium when Maine is the insured's home state Maine charges 3% of gross direct premium when it is the insured's home state; your broker handles the tax and may include it with the premium.
