Hawaii employment practices: broad state reach and a changed HCRC deadline

Hawaii’s Human Rights Law defines an employer broadly to include a person with one or more employees, including state and county government.     Hawaii’s statutory employer definition includes any person with one or more employees and expressly reaches state and political-subdivision employment. Do not assume that a small headcount removes state-law exposure. 1

  • Hawaii lists grounds beyond familiar federal categories

    HRS §378-2 includes, among other grounds, ancestry, sexual orientation, gender identity or expression, marital status, arrest and court record, reproductive health decisions, and certain domestic- or sexual-violence-victim circumstances. The statutory text includes conditions for some protections; assess the particular allegation rather than treating this as an unqualified list. 2

  • HCRC deadline changed in 2026

    Act 56 changed the HCRC filing period from 180 days to one year, effective on approval May 28, 2026. HCRC says the change applies prospectively and to claims that had not expired on that date; don’t apply the new period to an already-expired claim without legal advice. 5,6

  • State process and policy response are separate questions

    The statute provides HCRC administration and potential employment remedies. It does not answer whether a particular insurance form responds to an administrative complaint, demand, or lawsuit; obtain the actual wording and endorsements. 3,4
