Cargo insurance for West Virginia shipments
West Virginia's PSC rules separate cargo liability from bodily-injury and property-damage security. For nonhazardous freight, cargo minimums are $20,000 per vehicle below 10,000 pounds GVWR and $50,000 per vehicle/$100,000 aggregate at or above that threshold, subject to named commodity exceptions. 1
What Is Cargo And Transit?
Cargo coverage fits a shipper protecting goods it owns or a carrier responsible for another party’s goods. The quote needs to match who bears the loss, the shipment route and storage stops. Read the national Cargo and transit guide.
West Virginia Requirements
| Requirement | Details |
|---|---|
| Nonhazardous freight cargo limits | PSC Rule 150-9-3.3 lists $20,000 per vehicle and $20,000 aggregate below 10,000 pounds GVWR; at or above 10,000 pounds it lists $50,000 per vehicle and $100,000 aggregate for one or more vehicles at one time/place. 1 |
| For-hire annual insurance registration | Unless a stated exception applies, a for-hire motor carrier must file an annual insurance registration, pay the annual fee, file evidence of insurance or financial responsibility, and receive PSC approval. 1 |
What to Watch for in West Virginia
Do not treat auto liability as cargo security
PSC Rule 150-9-3.2 expressly excludes cargo from its bodily-injury/property-loss liability table and sets cargo limits separately in Rule 3.3. Request evidence of the cargo security as well as vehicle-liability proof. 1
Check both the per-vehicle cap and the one-time aggregate
At 10,000 pounds GVWR or more, West Virginia lists $50,000 per vehicle but $100,000 total aggregate for loss involving one or more vehicles at one time or place. A multi-truck incident or several shippers' loads can reach the aggregate before any single vehicle limit. 1
Confirm whether a commodity exception applies to the actual load
The rule's cargo minimums do not apply to vehicles transporting raw coal or only solid waste/other discarded property being taken to disposal. Do not generalize that exception to other coal products, salvageable goods, or a mixed cargo load. 1
Apply state and federal cargo rules to the right operation
The PSC rule reaches intrastate and interstate operations only to the extent state and federal law permit. FMCSA separately lists a $0 cargo filing for nonhazardous for-hire property carriers; confirm which authority applies and do not read a filing minimum as a goods-policy limit. 1,2
