What to Watch for in North Dakota
Report the site-work start accurately
North Dakota DEQ applies its construction general permit to one acre or more of disturbance, including smaller work within a larger development. It calls for a SWPPP, an NOI at least seven days before work, site inspections and a notice of termination after final stabilization. Ask the broker when quoted coverage starts relative to site preparation. 1
Identify the code-enforcement jurisdiction
The state updates the North Dakota State Building Code but local jurisdictions enforce it when they adopt codes; a jurisdiction can make local amendments and fully chartered home-rule cities may use a different code. The 2024 code updates took effect January 1, 2026. Give the broker the local authority, permit edition and construction schedule. 2
Fire-protection plans are a separate stage
For fire-protection systems, the State Fire Marshal says plans must be accepted before installation and directs most listed cities to their local authority having jurisdiction, with state review when no local authority exists. Include system installation and inspection milestones in the project description; ask how materials and partially completed work are treated. 3
