Builders Risk in Indiana

Indiana requires prior DNR approval for specified work in state-waterway floodways, including structures, deposits and excavation, and an unmapped floodway may still be regulated. FEMA floodway projects also raise a separate local no-rise or CLOMR step, so confirm the applicable path before fixing the start date. 1,2

What Is Builders Risk?

Builders risk protects the project you are building, including materials meant for it, against physical loss until construction ends. The gaps that cost owners money are materials in storage or transit, the existing building in a renovation, and coverage ending when you occupy early. Read the national Builders risk guide.

What to Watch for in Indiana

  • Do not treat an unmapped floodway as unregulated

Indiana DNR says floodways exist for all waterways even where not mapped and advises consultation for projects in unmapped areas. Ask DNR and the local official to screen the building, fill, access and staging footprint before mobilization. 1

  • Separate FEMA's no-rise path from the state permit

For projects in FEMA-mapped floodways, Indiana DNR describes a no-rise certification or CLOMR process before construction, with a LOMR after work for the CLOMR route. DNR also says its state floodway law still allows up to 0.14 feet cumulative surcharge, while FEMA/local NFIP rules require 0.00 feet or the applicable map-revision path; confirm both approvals rather than assuming one substitutes for the other. 2

  • Screen temporary work and deposits too

Indiana's Flood Control Act coverage described by DNR includes structures, obstructions, deposits and excavations in the floodway, not only the finished building. Have the engineer identify temporary fills, equipment and material staging that may need review so permit sequencing does not extend the period the project is exposed. 1,2

Questions to Ask Before You Buy in Indiana

  1. Has DNR confirmed whether the site lies in a mapped or unmapped state-waterway floodway, and which temporary construction activities are in scope?
  2. For a FEMA floodway, who will prepare the no-rise analysis or CLOMR/LOMR documents, and what are the local permit hold points?
  3. What flood, surface-water and resulting delay terms are included in the policy for the site, temporary works, stored materials and access?

Builders Risk in Indiana: FAQ

Does an unmapped Indiana floodway mean DNR has no authority? 1

No. DNR says floodways exist for all waterways even if they have not been mapped; consult the Division of Water about a proposed project in an unmapped area. 1

Does an Indiana DNR floodway permit alone satisfy the FEMA no-rise process? 2

DNR says FEMA no longer treats the state permit as satisfying the federal no-increase requirement; FEMA floodway projects may need a no-rise certification or CLOMR and a later LOMR, subject to the project path. 2
