Builders Risk in Illinois

Illinois DNR's floodway program reaches construction, fill, excavation and material storage, with jurisdiction and thresholds that differ by watershed and location. Confirm both state and local permits for the actual work area; a permit requirement does not establish insurance coverage. 1,2

What Is Builders Risk?

Builders risk protects the project you are building, including materials meant for it, against physical loss until construction ends. The gaps that cost owners money are materials in storage or transit, the existing building in a renovation, and coverage ending when you occupy early. Read the national Builders risk guide.

What to Watch for in Illinois

  • Check the stream and watershed threshold

Illinois DNR describes different watershed-size thresholds for urban and rural stream floodways. Where no floodway has been delineated, DNR says it generally requires a permit for work anywhere in the floodplain, so an absent line on a map is not enough to rule out review. 1,2

  • Include temporary materials and equipment in the permit screen

DNR's floodway FAQ treats storing materials as development alongside structures, fill and excavation. Ask the local floodplain administrator and DNR which portions of the construction site and staging area fall within jurisdiction before storing project materials there. 2

  • Confirm which state and local rules apply

Illinois identifies designated floodway rules for parts of Cook (excluding Chicago), DuPage, Kane, Lake, McHenry and Will counties, and notes that community floodplain requirements can be additional. Map the exact parcel and route approvals with the relevant local authority and DNR before mobilization. 1,2

Surplus-lines tax and stamping office

Reported tax rate: 3.5% of taxable premium plus a 0.04% stamping fee; separate 1% fire marshal tax on taxable fire premium When Illinois is the insured’s home state, the broker reports and remits a 3.5% tax on gross taxable surplus-line premium less returned taxable premium. The separate SLAI stamping fee is 0.04% for policies effective on or after January 1, 2023; a 1% fire marshal tax also applies to taxable fire premium. 7,6,10,11,8

Surplus Line Association of Illinois

  • Illinois guaranty fund limits: For covered claims against a member insurer, the Illinois Insurance Guaranty Fund generally caps its obligation at $500,000 per claim; workers’ compensation claims are excepted from that dollar cap. This fund does not protect policies issued by nonadmitted surplus-lines insurers. The net-worth exclusions apply to covered claims against member insurers. 8
  • Illinois FAIR Plan: If you cannot obtain basic property coverage in the voluntary market, the Illinois FAIR Plan offers a residual-market option for eligible property. Check its current eligibility and coverage limits before relying on it for a commercial location. 9

Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. Check the regulator’s license lookup and confirm availability with a provider when requesting a quote.

Questions to Ask Before You Buy in Illinois

  1. What is the watershed size and floodway status at the building, access route and material-storage areas, including any unmapped floodplain review?
  2. Which DNR, local, federal or delegated permits are required, and what approvals or inspections are schedule dependencies?
  3. Does the quote address flood or surface water at the worksite and offsite storage/transit locations, and what project-delay terms apply?

Builders Risk in Illinois: FAQ

If an Illinois floodway is not mapped, can work proceed without DNR review? 2

Not necessarily. DNR says its jurisdiction can extend into an undelineated floodplain, depending on the watershed threshold and project location. 2

Can temporary materials storage matter to an Illinois floodway permit? 2

Yes. DNR's FAQ includes storing materials among the activities that may be regulated in a floodway. Confirm how the rule applies to the specific site. 2
