# North Dakota builders risk: inspections and local code authority

North Dakota’s construction-stormwater program covers disturbance of one acre or more, including smaller work within a larger development; a notice is due at least seven days before construction and inspections continue through final stabilization. The state’s 2024 building-code updates took effect January 1, 2026, but enforcement is local and may include local amendments. Share the project jurisdiction, permit schedule and stage.[^1][^2]

## What Is Builders Risk?

Builders risk protects the project you are building, including materials meant for it, against physical loss until construction ends. The gaps that cost owners money are materials in storage or transit, the existing building in a renovation, and coverage ending when you occupy early. [Read the national Builders risk guide](/coverage/builders-risk).

## What to Watch for in North Dakota

### Report the site-work start accurately

North Dakota DEQ applies its construction general permit to one acre or more of disturbance, including smaller work within a larger development. It calls for a SWPPP, an NOI at least seven days before work, site inspections and a notice of termination after final stabilization. Ask the broker when quoted coverage starts relative to site preparation.[^1]

### Identify the code-enforcement jurisdiction

The state updates the North Dakota State Building Code but local jurisdictions enforce it when they adopt codes; a jurisdiction can make local amendments and fully chartered home-rule cities may use a different code. The 2024 code updates took effect January 1, 2026. Give the broker the local authority, permit edition and construction schedule.[^2]

### Fire-protection plans are a separate stage

For fire-protection systems, the State Fire Marshal says plans must be accepted before installation and directs most listed cities to their local authority having jurisdiction, with state review when no local authority exists. Include system installation and inspection milestones in the project description; ask how materials and partially completed work are treated.[^3]

## Who Regulates Insurance in North Dakota

**North Dakota Insurance Department.** The North Dakota Insurance Department regulates insurers and producers, provides licensing and company searches, and investigates insurance complaints to assess compliance with state law and policy terms.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.75% of gross premium, assessments and policy fees, less return premium, when North Dakota is home state When North Dakota is the insured’s home state, the 1.75% tax applies to the entire gross premium, assessments, membership and subscriber fees, and policy or service fees on multistate policies, less return premium. North Dakota permits independent procurement only under separate statutory conditions; the policyholder should confirm whether a licensed broker placement or independent procurement applies. Nonadmitted insurers generally do not participate in state guaranty funds.[^7][^8][^9]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://www.insurance.nd.gov/producers/print-license) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in North Dakota

1. Which city, county or township is enforcing building codes, and what code edition and local amendments apply?
2. Has the construction stormwater NOI been submitted at least seven days before the planned start, and who is the operator?
3. Who will accept fire-protection system plans, and what are the installation and inspection dates?
4. How does the quote handle materials and property before site work, during installation and after phased acceptance?

## Builders Risk in North Dakota: FAQ

### Does North Dakota’s construction permit threshold count a small phase by itself?

Not always. DEQ includes smaller construction projects that are within or part of a larger development that disturbs one or more acres.[^1]

### Does the state directly enforce one building code everywhere in North Dakota?

No. The state adopts and updates the State Building Code, while enforcement is by jurisdictions that adopt it; local amendments and a home-rule exception are possible. The 2024 code updates took effect January 1, 2026.[^2]
