Key Differences Between Coalition and Embroker
A New Application Can Change More Than the Buying Interface
EMIS replaces the two previous management-liability offerings for new customers. Embroker says existing policyholders can continue renewing their legacy products; switching to EMIS requires a new-business application. 27
EMIS brings management coverages and eligible technology E&O/cyber into one application and names Everspan Indemnity as insurer. Coalition markets Executive Risks alongside its digital-risk products, with insurer identity dependent on the placement. Ask whether the proposed move changes the insurer, continuity dates or coverage structure even if the broker and dashboard remain familiar. 27 5 3
Software and AI Claims Need the Proposed Endorsements
Embroker’s retail Tech E&O page lists intellectual-property infringement, copyright and libel among exclusions, while its broker program advertises software-code infringement coverage. The public descriptions do not reconcile that difference; request the proposed form and endorsements for your activities. 30,29
Embroker also describes an AI endorsement whose applicability to an EMIS or legacy quote needs confirmation. Coalition maps AI losses to existing cyber and eligible Tech E&O agreements and separately markets deepfake-response support. A software company should ask each broker to walk through a code-infringement allegation and an erroneous AI output against the actual form, without treating either AI label as unrestricted protection. 36 18
Higher Limits Are a Separate Placement Problem
The retail Tech E&O FAQ says Embroker’s excess product cannot sit above an Embroker primary policy. An Embroker primary buyer therefore needs a separate answer about how to obtain higher limits. 30
Coalition lists cyber excess with combined technology and MPL options, subject to review of underlying documents. That makes it a potential route to investigate, not proof it will accept an Embroker primary policy. Request written confirmation of compatibility before describing the two layers as a completed program. 14
What to Confirm in Quotes
Identify legacy versus EMIS terms, the AI endorsement edition, the treatment of software-code claims and any new application conditions. If adding excess, confirm which carrier can sit above the selected primary and how exclusions follow. Also ask what certificate and renewal access would change if you move brokers; Embroker describes restrictions for proprietary products outside its Access channel. 27 29 22 14
