Technology Liability and Patent Protection Need Different Questions
CFC’s U.S. technology brochure describes errors and omissions, cyber, media/IP infringement and general liability protection, including liability arising from client contract breaches. The brochure describes a package; the quote and wording determine which sections and exclusions apply. 2
CFC’s separate IP product describes infringement defense and pursuit, including patent exposures. That makes a second product inquiry relevant when the concern extends beyond the technology package’s media/IP section. Coalition’s Tech E&O description is a starting point for errors in products or services, but it does not establish equivalent patent protection. CFC’s January 2026 U.S. management-liability brochure lists California-domiciled business and standalone employment practices liability under risks it declines. This restriction is specific to the described management-liability offering; it does not establish a California exclusion for every CFC product. 11
This restriction matters if the same buying exercise includes D&O. Coalition describes its Executive Risks offering for qualifying private companies and nonprofits in all states, subject to its stated size criteria. CFC’s management restriction cannot be transferred to its technology product, whose current California route remains unresolved in the reviewed materials. CFC describes threat alerts, a response app and round-the-clock technical incident support. Coalition describes Control monitoring and remediation features, including account-connected capabilities. Provide the IP indemnity and the product description together. Request the covered IP rights, contractual-liability treatment, defense provisions and any separate policy required for patent disputes. Have the broker identify CFC’s current California technology insurer and admitted or surplus-lines route, and Coalition’s proposed Tech E&O paper.
