A financing round can bring two separate requests: management liability for the board and stronger technology coverage for customers. At-Bay’s combined Tech E&O addresses the latter. Embroker’s EMIS program groups management lines and eligible Tech E&O/Cyber under one application. The useful comparison is how those obligations fit together without losing track of each policy’s terms. 2 22

Key Differences Between at-Bay and Embroker

New Financing Can Coincide with a Program Change

Embroker describes EMIS as replacing its previous program for new business while legacy policies can renew; moving an existing account requires a new-business application. A renewal proposal and a fresh EMIS offer therefore need separate form and continuity checks. At-Bay’s technology quote should be compared with the actual proposed technology component, not the name of the older Embroker package. 22 2

Excess Limits Need an Eligible Underlying Policy

Embroker’s excess product requires qualifying underlying Tech E&O; cyber-only primary coverage is not enough. Its retail FAQ also says that product cannot sit above an Embroker primary. At-Bay markets primary and excess technology coverage, but that does not establish compatibility with the particular Embroker structure. Ask the arranging broker to draw the proposed layers and identify each attachment point and accepted underlying form. 26 2

A Brokerage Relationship Can Affect Future Access

Embroker warns that moving to a broker outside Embroker Access can affect renewal access to proprietary products and account servicing tools. At-Bay’s platform is itself broker-facing. For a company expecting to change advisers after funding, portability deserves attention alongside today’s coverage selection. 17 6

What to Confirm in Quotes

Request separate technology and management forms, continuity dates, eligible underlying insurance for any excess layer, and written California acceptance. Have Embroker identify whether the offer is EMIS or legacy business and reconcile its differing technology infringement descriptions before relying on that protection. 22 25 24

Its disclosed producer, At-Bay Insurance Services LLC, is a property and casualty agency and surplus lines broker; its website says coverage is underwritten by non-admitted insurers. 1,5

Embroker Insurance Services LLC is the producer named in its public lawyers’ liability specimen. Florida’s corporate record lists Embroker, Inc. as the LLC’s authorized member. That identifies a corporate relationship, not the insurer on your policy. 28,20

Embroker distributes proprietary programs through its own channel and through other brokers using Embroker Access. Its terms also allow it to perform underwriting work for insurers under their guidelines; the issuing insurer bears the policy obligations. 23,15

The reviewed corporate record identifies Embroker, Inc. as an authorized member of the producer LLC; it does not establish Embroker, Inc.’s ultimate beneficial ownership. 20

Application process

At-Bay describes a broker workflow of completing an application, adjusting limits and retentions, reviewing documents, selecting an effective date, and satisfying contingencies and signature requirements before binding. Brokers can also email submissions to underwriting. An online quote is not itself bound coverage. 6,4

The public quote-start screen asks for a company name and whether the company has a website. It links the terms and compensation disclosure before continuing. 39

An account alone does not appoint Embroker as your broker. Using its brokerage service requires a broker- or agent-of-record designation and exclusive work with Embroker for those services unless otherwise agreed. 15

An application may need additional underwriting information or be declined; a quote itself does not put insurance in force. 15

Access to insurers

At-Bay announced in August 2023 that eligible new E&S Cyber and Tech E&O business would be quoted on At-Bay Specialty Insurance Company paper. That historical announcement does not identify the insurer on a current California quote or establish the issuer for MPL. 11

The current MPL product page does not name its issuing insurer. A September 2023 announcement names United Specialty Company for MPL, but that historical reference is insufficient to establish the current contracting insurer or California placement. 4,13

Embroker names Everspan Indemnity Insurance Company as the insurer for EMIS and its excess Tech E&O/Cyber program. Its lawyers’ professional liability program names Everest National Insurance Company. These are product-specific relationships, not one carrier for the entire catalogue. 22,26,27,28

Servicing and renewals

At-Bay Stance offers vulnerability monitoring, fraud defense, employee security training and access to cyber advisors. Access is tied to the policy’s Embedded Security Fee and Endorsement; optional managed detection and response (MDR) is a separate purchase from At-Bay Security, LLC. 7

At-Bay markets Stance MDR for endpoints and email, plus managed extended detection and response (MXDR) spanning endpoint, email, identity and cloud. It says MDR is optional for insurance and available beyond its policyholders. Coverage enhancements and premium credits have qualifying conditions. 7

At-Bay describes broker dashboard access to active policies and renewals, with rapid and manual renewal paths. Its platform page says rapid renewals bind automatically 15 days before expiry; buyers should confirm enrollment, terms and change deadlines with their broker. 6

EMIS replaces the two previous management-liability offerings for new customers. Embroker says existing policyholders can continue renewing their legacy products; switching to EMIS requires a new-business application. 22

The FAQ describes downloadable policies and certificates for accounts where Embroker is the broker of record. Custom certificate wording may require a policy endorsement first. 17

Renewals vary: some policies renew through the insurer, while others need a fresh application and underwriting. Embroker describes reviewing the proposal, accepting it and paying or arranging financing; the new policy’s effective date controls when the renewal begins. 17

If you move to another broker, Embroker says you lose account-based certificate issuance and policy-change functions. A replacement broker outside Embroker Access may also be unable to renew proprietary products. 17
