Telehealth Insurance in New Mexico
New Mexico’s Telehealth Act does not expand professional scope or require health plans to cover telehealth; it encourages coverage within the plan’s terms. State law also preserves the licensing board’s supervision requirements, and New Mexico’s psychology board says clinicians need a New Mexico license to treat a patient physically present there. 1,2
What Is Virtual Care And Telehealth?
Telehealth liability can cover claims arising from remote health care, such as a video visit or remote monitoring. If you provide care online, match the quote to your clinicians, services and patient locations; cyber and in-person risks need separate review. Read the national Virtual care and telehealth guide.
What to Watch for in New Mexico
New Mexico Does Not Mandate Telehealth Coverage
The Telehealth Act encourages insurers and other payers to cover telehealth within their plans or policies but does not require coverage. Confirm each payer’s covered modalities and services before assuming video, audio-only, or store-and-forward work will be reimbursed. 1
Remote Care Must Follow the Same Supervision Rules
The 2025 amendment says the Act does not expand scope or authorize otherwise-unlawful settings, and providers must use the same level of supervision required for in-person practice. Ask the carrier to schedule supervised clinicians and identify the supervisor and services on the policy. 1
New Mexico Psychology Board Ties Practice to Patient Location
The New Mexico psychology board says a clinician must hold a New Mexico license to provide telehealth to a person physically present in the state. Confirm the patient’s location at each encounter and do not rely on the clinician’s home-state license alone. 2
Telehealth Act Provider Categories Expanded in 2025
Chapter 75 (SB 252), effective June 20, 2025, expressly includes licensed social workers and certified peer support workers among covered provider categories. Ask whether your roster includes those roles and whether the policy names the entities employing or supervising them. 1
Who Regulates Insurance in New Mexico

Surplus-lines tax and stamping office
Reported tax rate: 3.003% of taxable surplus-lines premium (verify allocation and current return instructions) New Mexico’s surplus-lines tax is listed as 3.003% of taxable premium in the state’s surplus-lines tax-return instructions; confirm current allocation and filing treatment with the New Mexico Taxation and Revenue Department because its current program page distinguishes broker-placed surplus lines from independently procured insurance. Surplus-lines coverage is issued by an unauthorized insurer and is outside ordinary state guaranty-association protection; do not treat the separate self-procured tax as the surplus-lines broker tax. 7,8,9,10
Providers With Documented State Licenses
No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. Check the regulator’s license lookup and confirm availability with a provider when requesting a quote.
