What to Watch for in Colorado
Out-of-State Registration Is a New 2026 Route
Beginning January 1, 2026, an out-of-state applicant may treat Colorado patients through registration with the regulator for the profession if the credential is active and unencumbered, its education and supervision meet the statutory equivalence test, and the applicant meets the other registration conditions. The applicant also must not have had a disciplinary action resulting in a credential limitation, suspension, or revocation during the five years before applying, unless that action concerned conduct or treatment Colorado law permits. This route does not itself show that a policy covers the clinician or services. Check each clinician’s eligibility and ask the broker to match the scheduled roster and Colorado patient services to the quote. 1
The Profession’s Regulator Sets Financial Responsibility
A registrant must maintain the method and amount of financial responsibility that the applicable regulator requires for services to Colorado patients. Colorado's statute does not set one limit for every profession. Confirm that regulator's actual rule, then ask the broker which entity, Colorado patient exposure, and telehealth services the policy includes. 1
Registration Does Not Permit Colorado In-Person Care
A provider relying on out-of-state registration may not open a Colorado office or provide in-person care to Colorado patients without the credential required for that profession. The route also bars a registered provider from prescribing a controlled substance; a 2025 addition says this section does not alter or limit rights and protections concerning a legally protected health-care activity, as defined in §12-30-121. That narrow qualification is not a general authorization to prescribe. Identify separate in-person and prescribing services before the broker schedules the risk. 1,3

Reported tax rate: 3% of net premium When Colorado is the insured’s home state, its surplus-lines tax is 3% of taxable premium. The Colorado Surplus Lines Association says insurer or broker fees charged in connection with the placement are included in the tax base; federal or other-state taxes and examination fees are excluded. For multistate risks, a tax-sharing agreement may allocate premium tax to other states. 7,9,8
