Telehealth Insurance in Kentucky
Kentucky physicians must obtain informed consent before providing or facilitating telehealth and maintain confidentiality. A separate statewide regulation applies to health-care providers generally and requires credentialing when a third party, insurer, or other payor requires it; optometrists have additional telehealth requirements and may not prescribe controlled substances through telehealth. These rules do not establish a professional-liability mandate or policy coverage. 1,2,3
What Is Virtual Care And Telehealth?
Telehealth liability can cover claims arising from remote health care, such as a video visit or remote monitoring. If you provide care online, match the quote to your clinicians, services and patient locations; cyber and in-person risks need separate review. Read the national Virtual care and telehealth guide.
What to Watch for in Kentucky
Consent Comes Before Physician Telehealth
Kentucky requires the treating physician to obtain the patient’s informed consent before telehealth services begin and to protect the confidentiality of medical information. Ask the broker to identify the physician and medical group responsible for the service and how the policy handles claims involving telehealth consent or record practices. 1
Payer Credentialing Can Be A Condition
Kentucky’s general telehealth rule requires providers to secure credentialing when a third party, insurer, or other payor requires it, and use appropriate coding for professional reimbursement. Ask your broker and payors to distinguish the policy’s insured-provider schedule from payor credentialing status; one does not establish the other. 2
Optometry Has Its Own Telehealth Limits
Kentucky optometrists must obtain consent acknowledging telehealth risks and limitations, verify identity, review history, maintain records, and secure any reimbursement credentialing; the rule bars their telehealth prescription of controlled substances. Ask whether optometrists and their actual service mix are included in your practice’s insured operations. 3
Who Regulates Insurance in Kentucky

Surplus-lines tax and stamping office
Reported tax rate: 3% on Kentucky-home-state premiums and other premium consideration; separate 1.8% surcharge on eligible risks located in Kentucky, subject to statutory exceptions; applicable local-government premium tax may also apply When Kentucky is the insured's home state, the state tax is 3% of premium and other consideration treated as premium; local-government premium taxes may also apply. A separate 1.8% surcharge generally applies to Kentucky risks, but state law exempts multistate nonadmitted risks and specified government and nonprofit premiums. The broker must make a diligent effort to place coverage with an admitted carrier before using surplus lines. 7,10,8,9,11
Providers With Documented State Licenses
No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. Check the regulator’s license lookup and confirm availability with a provider when requesting a quote.
