Track the 300-day commission deadline and oath requirement
A Nevada Equal Rights Commission employment complaint generally must be filed within 300 days of the alleged practice; timely filing with an appropriate federal agency within that period also counts under the statute. The complaint must state the practice and be signed under oath. Ask how the EPL form handles this allegation type, including wage-and-hour exclusions, defense sublimits, and notice triggers. 4
Private Company Indemnification
Under NRS 78.138, a plaintiff must establish a breach of the director’s or officer’s fiduciary duties and intentional misconduct, fraud, or a knowing violation of law; a presumption protects good-faith decisions made on an informed basis. As a private company, compare your bylaws and indemnity agreement with the policy’s advancement language; Nevada corporate statute does not itself promise insurance payment. 1
Separate Agency Intake From Court Timing
The statutory NERC window is not the same as the limitation for a later district-court action. Nevada also restricts a commission complaint after another comparable state or federal administrative body has decided the same facts and legal theory, so coordinate forum decisions with counsel.
