Oklahoma's marine-insurance section, in the Senate's Title 36 compilation posted in December 2019, includes bridges and tunnels unless only listed property perils are covered, and it expressly adds dams and appurtenant facilities for the control of waterways. What to Watch for in Oklahoma
Dams and Waterway Controls Are Named in the Marine Section
The 2019 compilation's marine section covers loss or damage to aids to navigation and transportation, including dry docks and marine railways, and dams and appurtenant facilities for the control of waterways. Bridges and tunnels are included unless fire, tornado, sprinkler leakage, hail, explosion, earthquake, riot, or civil commotion, or any of them, are the only hazards covered. A dam project written only for those perils is outside that sentence. 1
Commercial Inland Marine Is Exempt From the Special-Risk Filing
Section 997 exempts designated commercial special risks from the filing and review requirements of Section 987. The list includes all inland marine risks, separate from commercial lines risks that produce a minimum annual premium of $10,000. The Department's October 17, 2017 commercial inland marine checklist says commercial inland marine is exempted from filing rates and rules under that section. 1,2
Personal Inland Marine Is Not on That Exemption
The Department's personal inland marine checklist from the same date says personal inland marine is not exempted from filing rates and rules. A personal jewelry floater and a commercial equipment floater do not follow the same filing path. The checklists are 2017 department documents. A revoked rule, OAC 365:15-1-6, is not used as current law. 3
