What to Watch for in North Carolina
A Bridge Floater Drops Out If Only Named Perils Are Covered
G.S. 58-7-15(20) includes bridges, tunnels, and other instrumentalities of transportation and communication, excluding buildings, their furniture and furnishings, fixed contents, and supplies held in storage, unless fire, tornado, sprinkler leakage, hail, explosion, earthquake, riot, and/or civil commotion are the only hazards covered. If your quote covers only those named perils, it is not in this marine clause. Ask which additional perils are actually insured. 1
Piers and Docks Use the Same Named-Peril Boundary
The same subdivision excludes piers, wharves, docks, and slips from the marine kind when those same perils are the only hazards covered. A waterfront contractor should not assume a pier is inland marine because it touches the water. Match the peril list on the form to this test. 1
Jewelry Does Not Have to Be in Transit
The marine kind also covers precious stones, jewels, jewelry, and precious metals whether or not they are in transportation, and it includes personal property floater risks and marine builder's risks. The automobile bodily-injury exclusion in subdivision (20)b is limited to that liability class. It is not a general ban on scheduling a contractor's mobile equipment. If the Statute Is Silent, Custom or a Commissioner Ruling Fills In
G.S. 58-40-5(3) says inland marine insurance shall be deemed to include insurance defined by statute, or by interpretation, or if not so defined, by ruling of the Commissioner, or as established by general custom of the business.
