New Jersey inland marine insurance and the special-risk list

New Jersey's Department of Banking and Insurance places inland marine with ocean marine and automobile and aircraft physical damage in the same statutory lines paragraph. It also says a special risk under N.J.S.A. 17:29AA-3k includes inland marine insurance, so commercial inland marine is not on the ordinary prior-approval path. Personal inland marine rates, rules, and forms remain subject to prior approval. Bulletin 26-02 files some travel policies as personal inland marine and accident-and-sickness-only travel policies as accident and health. 1,2,3

What Is Tools, Equipment And Inland Marine?

If your business moves equipment between sites or ships goods, inland marine can cover those property exposures; installation and other forms address different property categories. Match the quote to what you own, rent or hold for others. Read the national Tools, equipment and inland marine guide.

What to Watch for in New Jersey

  • Commercial Inland Marine Is on the Special-Risk List

The property and casualty office says a special risk includes risks on the special-risk list, commercial lines risks producing minimum annual premiums over $10,000, inland marine insurance, or fidelity, surety, or forgery bonds. Inland marine is named on its own, not only when the premium exceeds $10,000. That classification changes filing. It does not tell you whether a tool floater covers theft from a van. 2

  • Personal Inland Marine Still Needs Prior Approval

The same office says personal inland marine rates, rules, and forms are subject to prior approval under N.J.S.A. 17:29A. A personal jewelry floater and a commercial contractors-equipment policy are not on the same filing clock. Ask which one you are buying. 2

  • Travel Policies Split Between Inland Marine and Accident and Health

Bulletin 26-02 says travel insurance is classified and filed as personal inland marine or as accident and health. Policies that cover only accident and sickness are filed as accident and health. All other travel policies are filed as personal inland marine. Do not assume a travel purchase is the same contract as goods in transit. 3

  • Inland Marine Shares a License Paragraph With Auto Physical Damage

The lines-of-authority chart maps ocean marine, inland marine, automobile physical damage, and aircraft physical damage to N.J.S.A. 17:17-1, paragraph b. The statute text itself was not opened, so this guide does not restate subclasses. A producer authority that includes that paragraph is not evidence that a particular floater is in force. 1

A New Jersey surplus-lines producer generally must make a diligent effort to place the risk with authorized insurers, subject to the exportable-list and other statutory exceptions. New Jersey’s separate surplus-lines guaranty fund has narrow coverage; ordinary commercial surplus-lines claims are generally outside guaranty protection. 8,9,10
