Key Differences Between Embroker and Founder Shield
AI Use Versus AI Product Eligibility
a professional-services company uses third-party AI to prepare client deliverables and is considering turning those tools into a paid software product. Founder Shield’s standalone offering targets businesses deploying AI in their operations and expressly excludes companies selling AI products. Embroker’s announcement describes an endorsement for eligible technology E&O/cyber quotes, including services delivered through AI. Put the planned business model in the application before treating the two offers as alternatives. 40 18
That difference is an eligibility distinction for specified products, not a finding that Founder Shield cannot arrange any insurance for an AI vendor. Founder Shield has a broader brokerage catalogue and describes customizing programs. Equally, Embroker’s AI announcement does not establish that every business using a chatbot qualifies for its technology program. Ask each broker to identify the product it would propose for the company’s current and planned activities. 37 38 18 11
For the services company, map three questions separately: liability arising from an AI output, professional errors in the work delivered, and a conventional cyberattack. Founder Shield’s AI page describes dedicated third-party liability and excludes standard cyberattacks. Embroker’s AI endorsement modifies eligible technology E&O/cyber coverage. A standalone AI policy should not be assumed to replace cyber insurance, and an endorsement should be assessed with the base policy it changes. 40 18
AI Policy Wording and Coverage Categories
Embroker describes AI services, discrimination allegations, regulatory-investigation defense and an algorithm-removal expense benefit. Those features matter when a customer contract requires the business to correct or withdraw an AI system. The announcement is not the endorsement itself, and its reference to the Startup Program needs confirmation for a particular current Management Insurance Suite (EMIS) or legacy quote. 18 9
Founder Shield’s AI page describes claims-made-and-reported protection, where both when a claim is made and when it is reported matter, and says defense spending reduces the policy limit. Its summary lists five coverage categories; Testudo’s broker page lists six, adding regulatory violations. Obtain the offered version and ask whether that additional agreement is included. The longer marketing list does not govern the policy. 40 41
An intellectual-property requirement in the new software contract narrows the comparison further. Embroker’s retail technology page and broker program describe infringement protection differently. Founder Shield lists AI-generated infringement among its AI categories, but eligibility and exclusions remain relevant. Ask for a written explanation of the rights and activities insured under each actual form, rather than treating an “AI” or “IP” label as blanket protection. 12 11 40
Management Liability and Issuing Roles
If the business adds outside investors or employee benefit plans while it grows, Embroker’s Management Insurance Suite offers directors and officers, employment practices and fiduciary liability in one application, with technology E&O/cyber for eligible technology companies. Buyers can choose components individually. Founder Shield offers individual coverages and customized packages; its directors and officers (D&O) page highlights the treatment of claims by major shareholders. Identify selected coverage and relevant exclusions rather than assuming one application or package buys every protection. 9 38 39
The issuing roles also differ. Embroker names Everspan Indemnity for EMIS. Founder Shield describes itself as distributor of the standalone AI product and Testudo as its underwriter; Testudo’s disclosure says its U.S. entity places insurance without bearing the risk. Get the actual insurer or syndicates on the proposal. Neither a program administrator nor Founder Shield’s Baldwin group relationship substitutes for that identity. 9 40 43 29
Business-Model Changes and Broker Transfers
Founder Shield asks clients to report new products, altered business models and new territories during the year. That reporting duty is relevant before the services company launches its software. Embroker’s current customers face a separate transition: its EMIS announcement permits legacy renewals but requires a new-business application to switch. In either route, request the amended or replacement terms before assuming the new activities are accepted. 45 9
A later brokerage change needs the same precision. Embroker’s FAQ says departure removes account-based certificate and policy-change functions, and a receiving broker outside Embroker Access may not renew proprietary products. If considering Founder Shield as the receiving broker, confirm actual program access and responsibility for earlier-work continuity. These sources do not establish Founder Shield’s Embroker appointment or imply that changing brokers cancels current coverage. 4 10 36
Compensation and Claims Support
Embroker provides free software and discloses commissions and possible negotiated client fees approved before binding. Founder Shield’s pricing FAQ says quotes generally include policy-period fees and charges, with full payment, carrier installments or premium financing available depending on the policy. Its terms and Baldwin’s group disclosure describe possible compensation separately. Ask for the annual insurance total and any borrowing cost, identifying which group-level arrangements actually apply. 3 48 28 49
Both document claims assistance: Embroker provides account reporting instructions and directs active cyber incidents to the policy hotline; Founder Shield describes portal reporting, claim tracking and advocacy over disputes. For the AI offering, obtain the reporting recipient and deadline for the specific form. Help from the broker does not change the insurer’s coverage decision or establish comparative settlement quality. 19 47 40
What to Confirm in Quotes
