What Doesn’t EPLI Cover?

Common exclusions can include wage-and-hour disputes, workers’ compensation claims, criminal acts, and uninsurable damages, but exclusions vary.

EPLI does not insure every workplace-related cost. The Insurance Information Institute identifies exclusions that may apply to claims under workers’ compensation, labor, safety, or benefits laws, and notes that punitive damages or criminal acts may be excluded. A Travelers sample form excludes or limits some types of loss and recognizes that insurability can depend on applicable law. Wage-and-hour coverage may be excluded, limited, or offered through a specific endorsement; privacy claims caused by a computer breach may fit another policy instead. Review the exclusions, defined “loss,” wage-and-hour endorsement, benefits exclusion, punitive-damages wording, and any carve-backs in your quote and issued policy.
