Does EPLI Cover Wrongful Termination?

Often, wrongful-termination allegations are a core EPLI claim, but the policy definition, exclusions, and claim timing control.

Triple-I lists wrongful termination among common EPLI claim types, including allegations of constructive discharge or retaliatory discharge. A Travelers sample form also defines wrongful termination by reference to applicable law, public policy, or an employment agreement. Those examples do not guarantee coverage: an insurer may dispute whether an allegation meets the wording, and exclusions, prior acts terms, notice requirements, or a wage-and-hour exclusion may affect a particular matter. Check the definition of wrongful employment practice and termination, who is insured, retroactive and prior-notice provisions, and whether the claim must first be made and reported during the policy period. Report demands promptly under the notice clause.
