Does EPLI Cover Retaliation?

Often, retaliation claims tied to protected activity are covered allegations in EPLI forms, subject to the wording and applicable law.

EPLI forms commonly include retaliation among employment-practices allegations. For example, a Travelers specimen defines retaliation to include certain adverse actions connected to legally protected activity; the definition is specific to that form. Federal agencies also enforce laws prohibiting retaliation in defined circumstances. Policy coverage is separate from the legal question of whether conduct was unlawful. Check the policy’s retaliation and wrongful-act definitions, claimant and insured definitions, exclusions, and any limits shared with other claims. Notice can be required before a lawsuit is filed if a written demand or administrative charge meets the policy’s claim definition, so follow the exact reporting instructions when a complaint arrives.
