Does EPLI Cover Failure to Promote?

Often, failure-to-promote allegations can fall within EPLI’s discrimination or failure-to-promote coverage, subject to the form.

Triple-I lists failure to promote as a common EPLI claim type. A Travelers sample form includes alleged failure to promote within its definition of wrongful employment practice, including certain denial of career opportunities. Whether a claim is covered depends on the policy’s wording, the claimant’s status, dates, notice, and exclusions; the policy does not establish whether the promotion decision was lawful or merit-based. Check whether the policy expressly includes promotion, training, demotion, and related employment decisions, and whether those allegations share limits with discrimination claims. Also verify the retroactive date and reporting requirements, especially if an employee first raised the issue before the current policy began.
