Wage-and-hour disputes are a policy-specific issue, not a safe assumption of standard EPLI protection. The Fair Labor Standards Act creates wage and overtime obligations and allows recovery of back wages and, in some cases, liquidated damages; an insurance form may exclude those payments or offer limited defense-cost protection by endorsement. Triple-I describes exclusions in EPLI but does not establish a universal wage-and-hour grant. Review the quote and specimen for wage-and-hour exclusions, sublimits, defense-only coverage, waiting periods, and treatment of back pay, liquidated damages, penalties, and attorneys’ fees. Ask whether the endorsement applies to individual claims and class or collective actions, and whether other state wage laws receive different treatment.
