Does EPLI Cover Independent Contractors?

Sometimes; some EPLI forms include contractors, but others distinguish them from employees or cover them only in defined circumstances.

Contractor status is especially wording-dependent. Triple-I says some EPLI policies may cover independent contractors, while a Travelers sample form treats an independent contractor as distinct from an employee and separately includes contractors in its claimant definition. That specimen does not settle whether a contractor working for your business is an insured person or eligible claimant under another policy. Misclassification questions can also involve laws beyond insurance. Check the definitions of employee, insured person, claimant, and independent contractor; ask whether defense applies to claims by contractors and claims against them; and confirm how temporary or leased workers are handled. Provide the insurer with accurate workforce and contractor information during underwriting.
