Does EPLI Cover Applicants?

Often, job applicants can qualify as EPLI claimants for hiring-related allegations, but confirm the policy’s definition and covered acts.

Applicants may allege discrimination or another wrongful practice during recruitment and hiring. Triple-I includes candidates in its description of people who may bring EPLI claims, and a Travelers sample form defines claimants to include applicants for employment. A buyer’s policy may define applicants differently or limit the relevant employment acts. Check whether a candidate who was never hired meets the claimant definition and whether hiring, screening, interview, and accommodation allegations fall within covered wrongful practices. Review the applicable protected-category wording, prior acts and notice terms, and any third-party or outside-position provisions. The policy’s response to defense costs remains subject to limits, retention, and exclusions.
